The results of tests conducted on Ahmed Fattouh, a Zamalek player, following the death of a police officer who was struck by the player’s car, have raised questions about whether they constitute sufficient evidence for conviction.

The tests, carried out at El-Alamein Model Hospital, showed that Fattouh tested positive for cannabis but negative for other narcotics such as tramadol.

A tragic accident..

Zamalek goalkeeper Mohamed Sobhi was with Fattouh in the car when they were returning from the North Coast before the incident involving the police officer. Fattouh was detained at a police station in the North Coast after undergoing these tests at the hospital.

A medical source familiar with the situation at El-Alamein Hospital told Masrawy that “the urine test showed Fattouh was positive for cannabis only, and negative for other narcotics like tramadol.”

The source added that “the test was conducted using a rapid test, not a quantitative blood test,” noting that this type of test is a preliminary indicator of drug use similar to what is used in traffic campaigns.

What does the law say?

Lawyer Ayman Mahfouz stated that a positive drug test is a strong piece of evidence in convicting someone accused of drug use and can be an aggravating factor in other crimes such as manslaughter or accidental injury.

However, he emphasized that “a positive test result alone is not a conclusive reason for conviction if the arrest and search procedures were invalid or if the accused was not caught in the act. Therefore, the positive test result might not be upheld if procedural issues are present.”
