A life-changing accident
The incident began when a driver’s negligence and lack of caution caused a serious crash with a motorcyclist crossing the road. The impact resulted in hospitalization and left the victim with a 22% permanent disability, according to medical reports. Due to the severity of these injuries, the individual had to leave a job, resulting in a total loss of steady income during a difficult recovery period.
Proving fault in court
Establishing responsibility was the key to this legal journey. Initially, a Criminal Court fined the driver QR 10,000, which provided the final legal proof of fault required for the civil case. The victim’s legal representative then submitted a memorandum showing that liability was clearly established under Article 89 of the Traffic Law. This law holds vehicle “custodians” responsible for damage caused by objects under their control, making the driver legally bound to the findings.
Justice and final compensation
In the final verdict, the Civil Court applied Articles 199, 201, and 216 of the Civil Code to ensure the payout matched the physical and psychological harm suffered. The judge ordered the driver and the insurance company to pay QR 300,000 in comprehensive compensation.
