UAE Labour Laws: “Your Employer Is Liable To Provide Medical Treatment If You’re Injured Whilst Working”

As an expat employee here in the UAE, it’s vital that you know of your rights regarding labour regulations and specifically, ‘workplace safety’ regulations – a subject of paramount importance for both employers and employees.

Enter Clause 13 of Article 13 in Federal Decree Law No. 33 of 2021 on the Regulation of the UAE Labour Law. Here, the spotlight is on an employer’s obligation to provide a secure and suitable work environment. Employees and employers alike are required to abide by the procedures outlined by the Ministry of Human Resources and Emiratisation (MoHRE) concerning occupational health and safety.

Moreover, according to the UAE Labor Law, if an employee is injured while performing their job duties, the employer is generally liable to provide compensation, medical treatment, and cover any related expenses

This includes both immediate medical treatment and ongoing medical care if necessary.

In case of a workplace injury, the following steps are advised:

  1. Keep Records: Employers and employees, keep records – medical stuff, talks, agreements. It’s crucial.
  2. Disputes: If there’s a fight about pay or anything else, UAE Ministry of Human Resources and Emiratisation (MOHRE) or labour courts step in.
  3. Compensation Claim: Can’t work due to injury? You might get paid. Follow UAE Labor Law rules.
  4. Medical Records: Note down all treatments and costs linked to the injury.
  5. Report It: Tell your boss ASAP about the injury. Most workplaces have steps for this.
  6. Prompt Medical Care: Injured? Get medical help fast. Employers cover the bill.

Following the employer’s instructions to ensure personal safety is given; so is refraining from actions that could undermine these directives. For employers, it’s all about ensuring a shield against potential occupational injuries and diseases. From the necessary protective gear to informative boards, there should be comprehensive precautions in place.
